Order Acceptance

All purchase orders submitted to PM Cables are subject to these Terms of Sale and Service. Acceptance of an order by PM Cables, including any written order acknowledgment, constitutes the complete and final agreement between the customer and PM Cables and supersedes all prior discussions, proposals, representations, or agreements, whether written or verbal.

Payment Terms

Unless otherwise agreed to in writing, payment terms are Net 30 days from the invoice date.

PM Cables accepts major credit cards. A 3.8% processing fee may apply to credit card transactions.

For new customer accounts placing orders valued at $100,000 or greater, a 25% non-refundable deposit is required before order confirmation and production begins. Deposits may only be refunded if PM Cables cancels the order or agrees otherwise in writing.

The remaining balance is due according to the approved payment terms.

Taxes

The customer is responsible for all applicable federal, state, provincial, local, sales, use, value-added, and other governmental taxes, duties, or fees associated with the purchase of products and services.

Shipping and Delivery

Unless otherwise specified by the customer, PM Cables ships orders using its preferred carriers.

Shipping charges will be billed to the customer unless alternative arrangements are specified in the quotation or purchase order.

Customers must inspect shipments upon receipt. Any visible shipping damage, shortages, or discrepancies must be reported to PM Cables within 10 calendar days of delivery.

Failure to report shipping damage, shortages, or discrepancies within this period constitutes acceptance of the shipment as delivered.

PM Cables reserves the right to refuse any returned products that are damaged, contaminated, improperly packaged, or otherwise unsuitable for handling or inspection.

Claims and Product Issues

All products are packaged in accordance with standard industry shipping practices.

Claims relating to incorrect items, manufacturing defects, shortages, billing discrepancies, or other order-related issues must be submitted in writing within 10 days of delivery.

Failure to submit a claim within this period will be deemed acceptance of the products and invoice, and the customer waives any related claims.

Upon receiving a valid claim, PM Cables will investigate the matter and, at its sole discretion, may repair, replace, credit, or refund affected products if the claim is determined to be valid.

Order Procedures

Orders may be submitted through authorized PM Cables sales representatives, by email, or through approved purchasing channels.

Products will be manufactured and supplied according to the specifications provided in the quotation, sales order, or purchase order. It is the customer's responsibility to verify that all product requirements, configurations, quantities, and specifications are accurate before submitting an order.

Additional charges may apply if changes, additions, or special requirements are requested after order acceptance.

PM Cables reserves the right to delay shipment until payment obligations have been satisfied.

If payment is not received within six (6) months of order completion or readiness for shipment, PM Cables may cancel the order and retain ownership of any unshipped products unless otherwise agreed in writing.

Cancellations and Returns

Because many PM Cables products are custom-manufactured or sourced specifically for customer orders, cancellations may be subject to charges up to the full value of the order.

No product may be returned without prior written authorization from PM Cables and issuance of a Return Material Authorization (RMA) number.

Approved returns must be received within 30 days of authorization and may be subject to a 20% restocking fee.

Customers are responsible for reviewing all quotations and order confirmations for accuracy. PM Cables will manufacture and supply products according to the approved order specifications.

Warranty

PM Cables warrants that its products will be free from defects in materials and workmanship under normal use during the applicable warranty period.

Warranty coverage begins on the original shipment date unless otherwise specified in writing.

The warranty applies only to defects associated with the original product supplied by PM Cables and does not cover:

  • Physical damage

  • Abuse or misuse

  • Improper installation

  • Unauthorized modifications or repairs

  • Fluid or environmental damage

  • Normal wear and tear

Products showing evidence of tampering, alteration, or removal of identification labels may have warranty coverage voided.

PM Cables' obligation under this warranty is limited to the repair, replacement, or credit of defective products at its sole discretion.

Warranty Returns

Customers seeking warranty service must contact PM Cables Customer Support to obtain a warranty authorization before returning any product.

Products returned without prior authorization may be refused and may not qualify for warranty coverage.

Core Returns and Advanced Exchanges

Products sold under an advance exchange or core return program must be returned to PM Cables within 30 days of receipt.

Failure to return eligible core products within the required timeframe may result in additional charges up to the full replacement value of the exchanged product.

Limitation of Liability

To the maximum extent permitted by law, PM Cables shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, revenue, business opportunities, or data arising from the use or inability to use its products or services.

PM Cables' total liability for any claim shall not exceed the amount paid by the customer for the specific product giving rise to the claim.

Governing Law

These Terms of Sale and Service shall be governed by and construed in accordance with the laws of the state in which PM Cables operates, without regard to conflict of law principles.
